General terms and conditions of sale for the products sold on the Store-juliet website

Article 1 - Subject matter
These terms and conditions govern the sale by the company "Juliet in the Hamptons of fashion, ready-to-wear and accessories collections, zero waste items for the home, natural care products.

Article 2 - Price
The prices of our products are indicated by default in euros all taxes included (VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding processing and shipping costs.

In case of order to a country different than the one of manufacture, you are the importer of the product or products concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums do not come under the jurisdiction of the company Juliet in the Hamptons.

They will be your responsibility and are your sole responsibility, both in terms of declarations and payments to the competent authorities and bodies in your country. We advise you to inquire about these aspects with your local authorities.

All orders, regardless of their origin, are payable in the currency selected on the site.

Store Juliet reserves the right to change its prices at any time, but the product will be charged on the basis of the tariff in force at the time of validation of the order and subject to availability.

The products remain the property of our partner until full payment of the price.

Attention: as soon as you take physical possession of the ordered products, the risk of loss or damage of the products is transferred to you

Article 3 - Orders
You can place an order only directly on the website. We dont receive orders by mail.

The contractual information is presented in english and will be confirmed at the latest at the time of validation of your order.

Store Juliet reserves the right not to register a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.

 

Article 4 - Validation of your order
Any order placed on the website www.store-juliet.com implies adherence to these General Conditions. Any order confirmation entails your full acceptance of these general terms and conditions of sale, without exception or reservation.

All the data provided and the recorded confirmation will be proof of the transaction.

You claim to be fully aware of it.

The order confirmation will be the signature and acceptance of the transactions carried out.

A summary of your order information and the present General Conditions will be communicated to you via the e-mail address confirming your order.

 

Article 5 - Payment
The fact of validating your order implies for you the obligation to pay the indicated price.

Payment for your purchases is made by credit card thanks to the secure Stripe and Paypal systems.

The card is only debited when the order is shipped. In the case of split deliveries, only the products shipped are debited.

 

Article 6 - Withdrawal
In accordance with the provisions of Article L.121-21, you have a withdrawal period of 14 days from the receipt of your products to exercise your right of withdrawal without having to justify reasons or pay a penalty.

Returns are to be made in their original state and complete (packaging, accessories, instructions). In this context, your responsibility is engaged. Any damage suffered by the product on this occasion may be such as to defeat the right of withdrawal.

The return costs are your responsibility.

In case of exercise of the right of withdrawal, store Juliet will proceed to the refund of the sums paid, within 14 days following the notification of your request and via the same means of payment as that used at the time of the order.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

In accordance with the provisions of Article L.121-21-8, the right of withdrawal does not apply to:

The supply of goods made up according to consumer specifications or clearly personalized.

 

Article 7- Availability
Our products are offered as long as they are visible on the site store-juliet.com and within the limits of available stocks. For products not stored, our offers are subject to availability from our suppliers.
In case of unavailability of product after placing your order, we will inform you by email. Your order will be automatically cancelled and no bank debit will be made.

Article 8 - Delivery
The products are delivered to the delivery address indicated during the order process, within the time indicated on the validation page of the order and its shipment ensured by DHL, UPS, Fedex, or other companies (depends on country of our partner manufacturer)

In case of delay of shipment, an email will be sent to you to inform you of a possible consequence on the delivery time indicated to you.  

In accordance with the legal provisions, in case of delay of delivery, you benefit from the possibility to cancel the order in the conditions and terms defined in article L 138-2 of the Consumer Code. If in the meantime you receive the product we will proceed to the reimbursement of the shipping costs under the conditions of article L 138-3 of the Consumer Code.

In case of deliveries by a carrier, store Juliet cannot be held responsible for delay of delivery due exclusively to unavailability of the customer after several proposals of appointment.

 

Article 9 - Guarantee
All our products benefit from the legal guarantee of conformity and the guarantee of hidden defects, provided by articles 1641 and following of the Civil Code. In case of non-compliance of a product sold, it may be returned, exchanged or refunded.

All claims, exchange or refund requests must be made by email or telephone within 30 days of delivery.

The products must be returned to us in the condition in which you received them with all the elements (accessories, packaging, instructions...). The shipping costs will be refunded on the basis of the rate charged and the return costs will be refunded on presentation of the proof.

The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.



Article 10 - Liability
The products offered comply with the Belgian legislation in force. The responsibility of store juliet cannot be engaged in case of non-compliance with the legislation of the country where the product is delivered. It is up to you to check with the local authorities the possibilities of importing or using the products or services you intend to order.

Furthermore, the legal entity Juliet in the Hamptons cannot be held liable for damages resulting from misuse of the purchased product.

Finally, Juliet in the Hamptons cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a breakdown of service, an external intrusion or the presence of computer viruses.

Article 11 - Law applicable in the event of disputes
The language of this contract is english. These terms of sale are subject to Belgian and European law. In the event of a dispute, the Belgian courts shall have sole jurisdiction.



Article 12 - Intellectual Property
All elements of the site store-juliet.com are and remain the property of the legal entity juliet in the hamptons. No one is authorized to reproduce, exploit, rebroadcast, or use in any way, even partially, elements of the site whether they are software, visual or sound. Any simple or hypertext link is strictly prohibited without an express written agreement of juliet in the hamptons.

 


Article 13 - Personal data
store juliet reserves the right to collect personal information about you. They are necessary for the management of your order, as well as for the improvement of the services and information we send you.

They can also be passed on to companies that contribute to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing and payment.

This information and data is also stored for security purposes, in order to comply with legal and regulatory obligations.

In accordance with the law of 6 January 1978, you have the right to access, rectify and oppose personal information and personal data concerning you directly on the website.

 

Article 14 - Archiving Evidence
The entity juliet in the Hamptons will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code.

The computerised registers of juliet in the Hamptons  shall be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
